That means Apple will once again have to stop selling its Apple Watch Series 9 and Ultra 2 devices that have the technology enabled starting at 5PM ET on January 18th. This is an obvious setback for Apple‚ which has been scrambling to find a way to circumvent the International Trade Commission’s import ban. Yep‚ the new feature is meant for more practical applications‚ but it seems the tool will happily respond to more colorful queries‚ too‚ answering the same questions people occasionally ask AI chatbots when they’re bored. Virtually every electronic device is capable of being hacked‚ including Apple's. To that point‚ Trail of Bits recently discovered a new attack through a GPU security flaw. Even though it seems Apple has addressed this issue in some iPhone and MacBook models‚ iPhone 12 and M2 MacBook Air owners are still unprotected against this security flaw. The security researchers at Trail of Bits discovered the LeftoverLocals vulnerability in the graphic processor units made by Apple‚ Qualcomm‚ and others. With this exploit‚ an attacker with local access to your iPhone 12 or M2 MacBook Air could read data in the GPU. In the article‚ they say they were able to read the results of an AI chatbot query. Interestingly‚ Trail of Bits reached out to Apple before publishing its findings. The company has addressed this issue with several devices‚ although some are still vulnerable: Despite multiple efforts to establish contact through CERT/CC‚ we only received a response from Apple on January 13‚ 2024. We re-tested the vulnerability on January 10 where it appears that some devices have been patched‚ i.e.‚ Apple iPad Air 3rd G (A12). However‚ the issue still appears to be present on the Apple MacBook Air (M2). Furthermore‚ the recently released Apple iPhone 15 does not appear to be impacted as previous versions have been. Apple has confirmed that the A17 and M3 series processors contain fixes‚ but we have not been notified of the specific patches deployed across their devices. To Wired‚ an Apple spokesperson said the company "shipped fixes with its latest M3 and A17 processors‚ which it unveiled at the end of 2023." However‚ the vulnerability remains on millions of existing iPhones‚ iPads‚ and MacBooks. Should you worry about this new security flaw? Yes‚ but not so much. Although this GPU exploit is pretty easy for hackers to access‚ the biggest issue is whether it could be chained to other attacks. Since hackers need local access‚ users don't need to worry that much. That said‚ a software update might be available soon for these devices that could prevent this security flaw in your M2 MacBook Air or iPhone 12. Last month‚ the US Court of Appeals for the Federal Circuit paused an import ban on the Apple Watch Series 9 and Apple Watch Ultra 2 as it considered Apple's request to continue selling the smartwatches during the appeal process. This week‚ the court officially denied Apple's request. As a result‚ imports of the Apple Watch models with blood oxygen features will once again be banned starting on Thursday‚ January 18 at 2:00 PM PT / 5:00 PM ET. For background‚ medical technology company Masimo has accused Apple of stealing its pulse oximetry technology for the Apple Watch. The International Trade Commission then upheld a judge’s ruling that Apple infringed on two of Masimo's patents‚ subsequently banning the import of the devices in the US last fall. Apple stopped selling the Apple Watch Series 9 and Ultra 2 in its stores‚ but they were still available at third-party retailers. After a temporary pause‚ Apple started selling Series 9 and Ultra 2 models in its physical stores and online at the end of December. Apple's victory was short-lived‚ though‚ and it's unclear what this means for Apple Watch sales in the coming weeks. Neither Apple nor Masimo have issued any response to the decision yet. 9to5Mac shared the court document on its website‚ which explains why the court decided not to grant Apple an extended stay during the appeals process: Rule 18 of the Federal Rules of Appellate Procedure authorizes this court to grant a stay pending this appeal. Our determination is governed by four factors: (1) whether the movant has made a strong showing of likelihood of success on the merits; (2) whether the movant will be irreparably harmed absent a stay; (3) whether issuance of the stay will substantially injure the other parties interested in the proceeding; and (4) where the public interest lies. Having considered all four factors‚ and the recent EOE Branch ruling‚ we lift the interim stay and deny Apple’s motion. We reach no conclusion on the merits of the appeal. Apple will reportedly remove the blood oxygen features from both the Apple Watch Series 9 and Apple Watch Ultra 2 in order to get around the ban. According to Bloomberg‚ Apple is working on a software update that will disable the features.
