Transgender Case 101: The Big Question Before Supreme Court

After the Civil War, the equal protection clause was added to the Constitution as part of the 14th Amendment to protect the rights of black Americans. Simply stated, the equal protection clause provides that every American is to be treated equally under the law.  In the case United States v. Skrmetti, attorneys representing the U.S. government argued Wednesday before the Supreme Court that the clause in the Constitution prevents states from banning transgender medical treatments for minors. (The case, which comes out of Tennessee, is named after that state’s chief law enforcer, Attorney General Jonathan Skrmetti.) The problem with the government’s argument, Heritage Foundation senior legal fellow Sarah Parshall Perry says, is that the high court already has determined that the equal protection clause applies only to immutable characteristics, qualities someone is born with, such as race or nationality.  “The Supreme Court has never determined that something that is subjective and internal, something that you choose and you act upon, is sufficient for constitutional protection,” Perry says on The Daily Signal’s “Problematic Women” podcast.  The Supreme Court has been asked to give protection under the equal protection clause to individuals with a certain poverty status or education level, Perry says, but “both times the Supreme Court has said, ‘No way.'”  The case before the high court follows passage of a Tennessee law banning transgender medical treatments for anyone under 18. Perry predicts that the court will send the issue back to the American people, allowing each state to pass laws regarding minors and such gender treatments.  Perry joins this episode of “Problematic Women” to discuss the high-profile case and its likely outcome.  Also on today’s show, we discuss President Joe Biden’s decision to pardon his son Hunter Biden. Ingredients: ½ cup of baking soda ½ cup of coconut oil 30-40 drops of essential oil of your choice 1 empty deodorant container Directions: Combine baking soda and coconut oil and mix well. Add 30-40 drops of essential oil of your choice and mix well. Add this mixture to an empty deodorant container and allow to harden before use. Homemade Deodorant Spray This recipe is perfect for those who prefer a deodorant spray over a solid deodorant! Ingredients: ½ cup of witch hazel ¼ teaspoon of baking soda ¼ cup of aloe vera gel (aloe vera juice will also work) 10 drops of clary sage essential oil Spray bottle Directions: Combine all ingredients into the spray bottle and shake well. It’s immediately ready to use. Just spray, allow to dry, and you’re all set! Homemade Deodorant For Sensitive Skin This recipe is perfect for those with slight to moderate sensitive skin. Ingredients: 5 tablespoons of coconut oil 2 tablespoons of bentonite clay 1 tablespoon of baking soda 6 tablespoons of arrowroot powder 5-10 drops of essential oil of your choice (You can combine scents if you like. Recommended oils for sensitive skin are frankincense and lavender.) Small mason jar with lid Directions: Combine all ingredients and mix well. Store the finished product in a sealed small mason jar. Does not require refrigeration. ** This homemade deodorant will have a paste like consistency. You can apply it using your fingers or you may use a cotton ball to apply. Wash your hands thoroughly after applying. Baking Soda Free Homemade Deodorant If you have tried homemade deodorants in the past but, found that the baking soda irritated your skin, then this homemade deodorant is for you! Ingredients: ½ cup of arrowroot powder ½ cup of coconut oil (slightly melted) 10-20 drops of tea tree essential oil (tea tree oil has antibacterial and antifungal properties) 10 drops of one or a combo of the following essential oils: frankincense, lemon, peppermint, or orange Small mason jar with lid Directions: Combine all ingredients and mix well. Store the finished product in a sealed mason jar. Does not require refrigeration. **Much like the sensitive skin deodorant recipe, this homemade deodorant will have a paste like consistency. In an absolutely insane reveal, a whistleblower has revealed that FEMA discriminated against Americans based on their political support under the Biden administration. Former hurricane relief supervisor Marn’i Washington admitted to ordering workers to skip homes displaying Trump signs after Hurricanes Helene and Milton, claiming it was part of FEMA’s “avoidance” policy. Government employees reported that at least 20 homes featuring Trump signs or flags were bypassed from the end of October into November as the temperatures dropped, due to “best practices” guidance. Now, other FEMA employees claim her admission was an “isolated incident.” However, the former FEMA employee alleged that the orders came from her superiors and this was not an isolated incident at all. Rather, Washington explained that “this was the culture.” “They were already avoiding these homes based on community trends from hostile political encounters. It has nothing to do with the campaign sign. It just so happened to be part of the community trend," Washington said. But it gets worse. Keith Malinak of “Pat Gray Unleashed” spoke with X account user @EmergencyRV, who posted video footage of hundreds of trailers owned by FEMA that could be housing those displaced by the hurricane — and are instead sitting in a large lot, unused. “They’re just sitting there, rotting. And people chimed in on the comments and said, ‘Yup, I’ve seen trailers like this, and such and such, where grass is growing all over them.’ It’s insane,” Malinak tells Pat Gray and Jeffy. “You could house every out-of-their-home, every homeless person who got wiped out in these catastrophes, right now,” Gray says, disturbed. “That’s your tax dollars at work, right there,” Malinak adds. Hours after joining President-elect Donald Trump at Mar-a-Lago to help raise money for Prager University, nationally syndicated radio host and co-founder of Blaze Media Glenn Beck noted that the Republican's loss in 2020 was a "blessing." "It is a miracle that he lost in 2020," Beck said Wednesday on "The Glenn Beck Program." "You listen to this show. You remember what I was saying. 'We're all doomed. We're all going to die. The country is over if we don't correct this in four years.'" The Biden administration has managed to inflict a great deal of damage, not least by its failure to prevent tens of millions of foreign nationals from stealing into the homeland and by its weaponization of the Department of Defense against perceived political foes. Nevertheless, Beck suggested there was at least one benefit to Trump serving nonconsecutive terms: the benefit of time and experience. Beck suggested that there was a profound difference between the Donald Trump who might have taken office in 2021 and the man he spoke to this week — a difference that may bode well for the United States of America. 'I'm thinking about saying it without any context just to freak people out on the left.' "I have met with presidents before. I met with Ronald Reagan; I met with George H.W. Bush; I met with George W. Bush; and I met with Donald Trump. I have more confidence in Donald Trump now than any other president I've met. The guy is super, super informed," said Beck. Beck suggested that Trump was gifted four years during which he could contemplate the nature of the political establishment set upon his ruin as well as optimal ways of fighting back. "He had four years to go, 'Okay. What did I do wrong? How did they get me? How did they thwart me? How do I stop it? And how do I reverse this machine while dismantling this machine?'" said Beck. "He is laser-focused on that." "He has — and I'm going to say this, and I'm thinking about saying it without any context just to freak people out on the left — Donald Trump has a 12-year plan," said Beck. "This is a well thought-out plan. Every time I talk to him, I am filled with more confidence." The election results and recent polling indicate that Americans are generally more confident in Trump now than in 2020 and increasingly amenable to his campaign promises. According to an Emerson College poll released last week, Trump's favorability rating jumped six percentage points from earlier this month to 54%. Blaze News previously noted that's a big deal, especially given Gallup's claim that Trump never cracked 50% during his first term. Although Trump has had to contend with seemingly nonstop lawfare, four years was evidently ample time for him to contemplate appointments and strategies, both domestic and international, should he make a comeback, some of which he delineated in his his Agenda47 manifesto. Beck was reluctant to divulge too much of what Trump shared with him but indicated that he has a mind to "get the Abrahamic Accords back" and restore relative peace in the Middle East; to bring NATO and Russia back from the brink of nuclear holocaust; to bring inflation and prices under control; and to altogether "get our house in order." President-elect Donald Trump's legal team filed a request to dismiss the Georgia indictment that accused him of attempting to overturn the 2020 presidential election.On Wednesday, Trump's attorney, Steven Sadow, contended that the state-level case should be thrown out over a "lack of jurisdiction," arguing that "a sitting president is completely immune from indictment or any criminal process, state or federal."Moving forward with sentencing ... would be 'uniquely destabilizing' for the country.Sadow pointed out that the Department of Justice filed motions to dismiss both federal indictments against Trump — one of which mirrored the allegations in Georgia — following his victory in the November presidential election."President Trump has filed a motion requesting the Georgia Court of Appeals confirm its lack of jurisdiction to continue hearing his appeal now that he is President-Elect and will soon become the 47th President of the United States, and then direct the trial court to immediately dismiss the case. The filing states that any ongoing criminal proceeding against a sitting president must be dismissed under the U.S. Constitution," Sadow wrote.Trump is no longer facing any federal indictments. DOJ expenditures, reviewed by Fox News Digital, revealed that the Biden administration's lawfare against Trump cost taxpayers at least $50 million.The New York criminal case in which Trump was found guilty on all 34 counts of falsifying business records is currently up in the air. In that case, Judge Juan Merchan accepted the defense's request to file a motion for dismissal for his review. Trump's attorney in the case, Todd Blanche, argued that Trump's presidential win was "a mandate that supersedes the political motivations of DANY's 'People,'" referring to Manhattan District Attorney Alvin Bragg. He noted that moving forward with sentencing, which was originally scheduled for July, would be "uniquely destabilizing" for the country.The Georgia indictment, which never went to trial, has been tied up in the courts after Fulton County District Attorney Fani Willis was caught having an affair with special prosecutor Nathan Wade, who has since stepped down. A state appeals court abruptly canceled a December 5 pretrial hearing to determine whether Willis should be disqualified from the case. The court stated that the hearing would be canceled "until further order." Some speculated that the court's cancelation may indicate that it plans to boot Willis from the case on the merits without requiring an oral hearing. The court is expected to make a decision by the spring.The Fulton County District Attorney's Office did not respond to a request for comment from WXIA-TV.Like Blaze News?
