According to a Wisconsin-based legal firm, a voter identification loophole could allow nearly 150,000 voters in the battleground state to vote in the 2024 presidential election without an ID. “Voters can self-identify as ‘Indefinitely Confined,’ allowing them to continually receive an absentee ballot without ever showing an ID,” the Wisconsin Institute for Law & Liberty wrote. “In our report ‘Wisconsin’s Voter ID Loophole: The Continuing Problem Of Indefinitely Confined Voters’ we hope to raise awareness of this issue and ensure clerks are performing their duty to remove voters who are no longer eligible for the status,” the firm added. This state accommodation designed for the disabled, elderly, ill and infirm came under the spotlight in 2020 when Wisconsin’s two largest cities — Milwaukee and Madison — told citizens to use the little-known law to vote without a photo ID during COVID restrictions. President Biden won the state by almost 21,000 votes in 2020; former President Donald Trump won by about 27,000 in 2016. Polls show Trump and Vice President Kamala Harris neck and neck this year. “Our latest findings reveal that over 140,000 Wisconsin voters might cast their ballots without showing ID in the 2024 election. The ‘Indefinitely Confined’ status, intended for those truly unable to vote in person, is being exploited,” Wisconsin Institute for Law & Liberty stated. Watch more pic.twitter.com/ERWflK7IKk — WILL (@WILawLiberty) September 9, 2024 The Center Square reports: While it found no evidence of voter fraud in previous elections, WILL cited the lack of confidence some have in the democratic process, warning that neglecting to fix the the issue could invite otherwise preventable challenges to the 2024 November election results. “The potential 142,000 voters using indefinitely confined status in the 2024 election will doubtless be used to sow seeds of doubt about the outcome of the upcoming election, and responsible politicians on both sides of [the] aisle should work to fix this glaring issue in the future,” WILL said. The September report found that despite many of the “indefinitely confined: voters no longer fulfilling the eligibility requirements for this status, election clerks across the state have neglected to remove them from the list. “The indefinitely confined status was designed to provide those who are elderly, sick, or physically unable to get to the polls with an opportunity to vote. Although designed with good intentions, as our report shows, the system has a few key flaws that should be resolved,” WILL Policy Director Kyle Koenen said.
