Judge Dismisses Trump Classified Documents Case

Special counsel Jack Smith‘s classified documents case against former President Donald Trump was dismissed by the presiding federal judge in Florida on Monday. District Court Judge Aileen Cannon, who was nominated to her position by Trump, said Smith’s appointment as special counsel was unconstitutional. The indictment “is DISMISSED because Special Counsel Smith’s appointment violates the Appointments Clause of the U.S. Constitution,” Cannon wrote in an order granting Trump’s motion to dismiss. Cannon also found that Smith’s “use of a permanent indefinite appropriation” violated the Appropriations Clause of the Constitution, but she said the court “need not address the proper remedy for that funding violation given the dismissal on Appointments Clause grounds.” The judge further stated the “effect of this Order is confined to this proceeding.” Smith did not immediately comment on the ruling. The Daily Wire has reached out to the Department of Justice for comment. In a post to Truth Social, Trump declared “this dismissal of the Lawless Indictment in Florida should be just the first step, followed quickly by the dismissal of ALL the Witch Hunts.” Defense lawyers and prosecutors argued for and against dismissal on constitutional grounds last month. While Trump’s legal team argued that Smith’s position was tantamount to a “shadow government,” prosecutors argued they were “following the rules.” The dismissal comes two days after Trump survived an assassination attempt at a rally in Pennsylvania. A gunman opened fire and a bullet ripped through Trump’s ear. Secret Service personnel killed the shooter, but not before one rally-goer was killed and two others were injured. Smith was appointed as special counsel by Attorney General Merrick Garland in November 2022. He was tasked with taking over the investigations into Trump’s retention of classified documents after leaving office and second one related to the 2020 election. Trump has contended with four criminal cases as he ran another campaign for the White House. He faced dozens of charges related to willful retention of classified documents and obstruction in the classified documents matter. Smith is still leading the case in Washington, D.C., that led to charges against Trump related to the 2020 election. Fulton County District Attorney Fani Willis is spearheading a separate 2020 election case in Georgia that also resulted in charges. The former president has pleaded not guilty throughout. He has also had to deal with gag orders in some of the cases. In May, a jury convicted Trump on dozens of felony counts in a New York hush-money case. Sentencing has been postponed until at least September as Trump seeks to get the conviction thrown out after the Supreme Court ruled that he has immunity for official acts.

Just a few months before Saturday’s assassination attempt on former President Donald Trump, a House Democrat introduced a bill that would strip Trump of his Secret Service protection if he is sentenced to prison. Representative Bennie Thompson (D-MS) introduced the “Denying Infinite Security and Government Resources Allocated toward Convicted and Extremely Dishonorable Former Protectees Act” or the “DISGRACED Former Protectees Act.” The bill would automatically terminate Secret Service protection for anyone convicted of a felony and sentenced to prison. Prison authorities would be responsible for their safety rather than the Secret Service. Thompson introduced the bill back in April, more than a month before Trump was convicted of 34 charges in the hush money case relating to porn performer Stormy Daniels. “Unfortunately, current law doesn’t anticipate how Secret Service protection would impact the felony prison sentence of a protectee — even a former President,” Thompson said in a statement at the time. “It is regrettable that it has come to this, but this previously unthought-of scenario could become our reality,” he said. “Therefore, it is necessary for us to be prepared and update the law so the American people can be assured that protective status does not translate into special treatment — and that those who are sentenced to prison will indeed serve the time required of them.” Thompson also grabbed headlines over the weekend after one of his staffers posted on social media that she hoped the gunman who shot Trump in his ear “wouldn’t miss next time.” “I don’t condone violence but please get you some shooting lessons so you don’t miss next time ooops that wasn’t me talking,” Jacqueline Marsaw, Thompson’s field director, wrote on Facebook Saturday evening shortly after the assassination attempt on Trump. Marsaw also wrote that the shooting “couldn’t [have] happened to a nicer fellow,” although she also called it “staged.” “That’s what your hate speech got you!” she wrote. Thompson later confirmed that Marsaw was no longer working for him. At a Saturday rally in Butler, Pennsylvania, a gunman attempted to assassinate Trump from a nearby rooftop, firing a bullet that grazed the former president’s ear before the Secret Service evacuated Trump. Law enforcement returned fire immediately, killing the shooter. At least one rallygoer was killed, and two others were injured. Footage of the incident showed Trump ducking behind the podium before being escorted away by the Secret Service with blood on his ear and face. He raised his fist as he left and shouted “Fight!” to the crowd. Thompson is the current ranking member of the House Homeland Security Committee and previously chaired the House January 6th Committee. The Secret Service bill was co-sponsored by Representatives Troy Carter (D-LA), Barbara Lee (D-CA), Frederica Wilson (D-FL), Yvette Clarke (D-NY), Bonnie Watson Coleman (D-NJ), Jasmine Crockett (D-TX), Joyce Beatty (D-OH), and Steve Cohen (D-TN).

Actress Shannen Doherty of “Beverly Hills, 90210” and “Charmed” fame has died at the age of 53. She passed away after battling breast cancer for several years. Her publicist Leslie Sloane shared the update, per NBC News. “It is with a heavy heart that I confirm the passing of actress Shannen Doherty. On Saturday, July 13, she lost her battle with cancer after many years of fighting the disease,” Sloane wrote. Doherty was first diagnosed with breast cancer in 2015 and later went into remission following treatment. She shared a post on Instagram in June 2023 detailing how the cancer had spread to her brain. “On January 5th, my scan showed (metastasis) in my brain,” she posted at the time. “My fear is obvious. I am extremely claustrophobic and there was a lot going on in my life,” Doherty continued. “But that fear…. The turmoil….. the timing of it all…. This is what cancer can look like.” The actress scored a major role in 1982 when she was cast as Laura Ingalls Wilder’s adopted daughter on the popular TV series “Little House on the Prairie.” She was 10 years old at the time. This role led to others, including Maggie Malene in “Girls Just Want to Have Fun” (1985), Kris Witherspoon in the series “Our House” (1986–1988), and Heather Duke in the teen comedy-drama “Heathers” (1989). Doherty was next cast in her breakout role on “Beverly Hills, 90210.” She became a superstar for her portrayal of Brenda Walsh as the drama became a national sensation. Doherty had a tumultuous love life, marrying and divorcing three different men over the years. She had no children. The actress gave a heartbreaking interview in December detailing how she wasn’t ready to give up on life. “I don’t want to die,” she told People magazine at the time, as The Daily Wire previously reported. “I’m not done with living. I’m not done with loving. I’m not done with creating. I’m not done with hopefully changing things for the better. I’m just not — I’m not done.” She added, “When you ask yourself, ‘Why me? When this distressed mother called the police in the wee hours of the morning, she had no idea that one officer would go to such great lengths to help her out! This Ohio mom was desperate to feed her week-old child after realizing that her milk had dried up. Unable to breastfeed the baby, she needed formula. However, since it was around three in the morning, so there was nowhere to buy it. That’s when she decided to call for help. Thankfully, Corporal Hunter Willoughby was on it in a heartbeat! As soon as he heard the mother’s predicament, the police officer rushed out to find some baby formula for her. When he arrived at a local Meijer, they were obviously closed. However, when he explained the situation, they were willing to open the store so that he could purchase the formula and some bottles. USA Today tells us that he brought the items over to the waiting mom’s house as soon as he got them. On Facebook, Miami Township Police shared Corporal Willoughby’s incredible act of kindness. They also included footage from his bodycam as he searched the Meijer for baby formula. Although the police officer was a little confused about what products to buy for the distraught mother, he eventually figured it out — with some help from an employee. Police commended the officer for his act of kindness toward a mother in need. Chief Mike Mills wrote a touching message in the caption of this video. “You don’t often hear about everything a police officer does in the course of their shift, but I do and this is an example of the Miami Township Way,” his post read. “During the overnight hours, Corporal Hunter Willoughby received a frantic phone call from a post-partum mother who advised she was unable to feed her one week old infant.” Chief Mills added, “Cpl Willoughby personally purchased some formula and bottles for the mother and delivered the items to the appreciative mother and he refused to accept any payment for the formula or bottles.” What an incredible act of service! Tiger sharks are common along the Florida coast. While sometimes dangerous, they can be beautiful to observe as they navigate beneath the water. Some people, like Kinga Phillips and Shane Reynolds, are comfortable diving and swimming with them. When Shane isn’t in a wetsuit, he can be found above the surface dropping a camera into the water. The shallow, clear water makes for great shark-watching. Shane Reynolds is an Underwater Cinematographer, Drone Pilot, and Surfer. He is the mastermind behind Color Earth Pro Productions. You may also recognize him from his appearances on various shark programs. This year, Shane and Kinga Phillips volunteered to assist Okaloosa County with data collection. At the base of the pier is a transponder from which they retrieved data. They also used the opportunity to film the shark activity. Tiger sharks congregate near Okaloosa Pier because food is plentiful due to a phenomenon known as “school-induced hypoxia.” When schools of bait fish become too large, they crowd, and some drop dead to the bottom due to lack of oxygen. The tiger sharks feed on the dead bait fish under the pier. With plentiful food, the tiger sharks will continue to return year after year. Although tiger sharks can be dangerous, they pose little threat to humans when food is plentiful. Their average length is around 14 feet, but they can grow up to 20 feet and weigh as much as 1,000 pounds. They are opportunistic feeders and will eat just about anything.
