Jack Smith moves to dismiss charges against Trump before Inauguration Day

On Monday, special counsel Jack Smith filed a motion to dismiss the Washington, D.C., case filed against President-elect Donald Trump.Trump was initially charged last year with four felony counts, including conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of an attempt to obstruct an official proceeding, and conspiracy against rights. He pleaded not guilty to all charges. 'Today's decision by the DOJ ends the unconstitutional federal cases against President Trump, and is a major victory for the rule of law.'Smith wrote in the motion, "As a result of the election held on November 5, 2024, the defendant, Donald J. Trump, will be inaugurated as President on January 20, 2025. It has long been the position of the Department of Justice that the United States Constitution forbids the federal indictment and subsequent criminal prosecution of a sitting President."Smith noted the "unprecedented situation" and, after consulting with the DOJ's Office of Legal Counsel, concluded that the "prosecution must be dismissed before the defendant is inaugurated.""The Government's position on the merits of the defendant's prosecution has not changed. But the circumstances have," he added.Smith led the Washington, D.C., case as well as another federal indictment against Trump out of Florida, where Trump was accused of mishandling classified documents. That case was dismissed in the summer by Judge Aileen Cannon, who ruled that Smith's appointment was unconstitutional. Smith's move to drop the Washington, D.C., case on Monday would mark the end of all the federal indictments against Trump.Steven Cheung, a spokesperson for Trump, responded to Smith's decision to file the motion to dismiss.Cheung said, "Today's decision by the DOJ ends the unconstitutional federal cases against President Trump, and is a major victory for the rule of law. The American People and President Trump want an immediate end to the political weaponization of our justice system and we look forward to uniting our country."Trump had previously vowed to terminate Smith "within two seconds" of taking office. The New York Times reported earlier this month that sources revealed Smith was planning to wrap up the federal cases and retire before Trump had the opportunity to remove him as special counsel.Trump is still facing a criminal conviction in the New York court system, where he was charged with 34 felony counts of falsifying business records. However, last week, Judge Juan Merchan granted the defense's request to file a motion to dismiss. Merchan will receive that motion and the prosecution's response in early December. The Georgia case lodged against Trump, also a state-level indictment, is still tied up in the court and has not gone to trial.Like Blaze News? Kamala Harris already scheming for her next office: 'I am staying in the fight'

Fresh off of a devastating loss for the Democratic Party that cost more than a billion dollars, Vice President Kamala Harris is ready to hop back on the horse, according to a Politico report. The report says that Harris has told her aides and allies to keep their options open as she considers either running for president again or running for governor of California. 'The natural thing to do would be to set up some type of entity that would give her the opportunity to travel and give speeches and preserve her political relationships.' Harris presided over the Democrats' loss of the Oval Office and the U.S. Senate and the retention of the U.S. House by Republicans. Democrats have been attacking each other to place blame for their failures and also to jockey for position in the party going forward. The report says Harris has repeated a new mantra in numerous phone calls: “I am staying in the fight.” Harris plans to reassert her leadership in the party and become a prominent voice for the opposition in Trump's second term. “She doesn’t have to decide if she wants to run for something again in the next six months,” said a former Harris aide to Politico. “The natural thing to do would be to set up some type of entity that would give her the opportunity to travel and give speeches and preserve her political relationships," the source added. Brian Brokaw, a former Harris aide, told Politico she likely hasn't made a decision and usually takes a long time to consider her options. “She is not someone who makes rash decisions," said Brokaw. "She takes, sometimes, a painfully long time to make decisions. So I would pretty much guarantee you she has no idea what her next move is." Some Democrats have blamed President Joe Biden for staying in the campaign for too long and not giving Harris a chance to solidify the party behind her, but others blame the Harris campaign for spending on lavish parties with celebrities. And finally, Rep. Alexandria Ocasio-Cortez (D-N.Y.) called on people to blame a Jewish political group. Like Blaze News? President-elect Donald Trump endorsed Jimmy Patronis, Florida's chief financial officer, to replace former Republican Rep. Matt Gaetz after the Florida firebrand resigned his congressional post. Gaetz resigned from Congress shortly after Trump nominated him for attorney general, sparking a slew of online and media controversy. Less than two weeks later, Gaetz decided to withdraw his bid for attorney general so as not to further distract from the Trump transition team. Gaetz confirmed that he does not intend to return to serve in the 119th Congress, leaving the seat vacant.As a result, Patronis' name was floated as a potential Gaetz replacement. Patronis, who has long been an ally to Trump, earned his wholehearted endorsement. "Jimmy Patronis, Chief Financial Officer for the Great State of Florida, has done a tremendous job as CFO, where he also serves as the State's Fire Marshall, and as an important member of the Florida Cabinet," Trump said in a Truth Social post Monday. "I hear that Jimmy is now considering launching a Campaign for Congress in Florida's 1st Congressional District!" 'Should he decide to enter this Race, Jimmy Patronis has my Complete and Total Endorsement.'Trump pointed to Patronis' political experience as well as local ties to Florida's 1st district, further bolstering the endorsement. "A fourth generation Floridian from the beautiful Panhandle, and owner of an iconic seafood restaurant, Jimmy has been a wonderful friend to me, and to MAGA," Trump continued. "I hear that As your next Congressman, Jimmy would work tirelessly alongside of me to Grow our Economy, Secure our Border, Stop Migrant Crime, Strengthen our Incredible Military/Vets, Restore American Energy DOMINANCE, and Defend our always under siege Second Amendment.""Should he decide to enter this Race, Jimmy Patronis has my Complete and Total Endorsement," Trump said.
