Challenging Trump, California to Pay for Illegal Immigrant Deportation Defense

THE CENTER SQUARE—Sen. Alex Padilla, D-Calif., reiterated the state’s commitment to continued funding for the deportation defense of migrants and undocumented immigrants. President-elect Donald Trump’s promised mass deportations could have a major impact on California, which hosts approximately 2.7 million undocumented immigrants. “If it’s legal assistance, legal advice, legal support, that’s just the California way,” Padilla said when asked if the state would fund legal defenses of undocumented immigrants facing deportation. “We embrace our diversity. Our diversity has made our communities thrive and our economy thrive.”  Given the state’s looming deficits, Republicans wondered whether such funds would be better spent elsewhere. “The idea that we would use our tax dollars to defend criminal illegal immigrants is outrageous,” wrote state Assemblyman Bill Essayli, R-Corona, on X (formerly Twitter). “How about we use that money to support the victims of the crimes committed by illegal immigrants?” The idea that we would use our tax dollars to defend criminal illegal immigrants is outrageous. How about we use that money to support the victims of the crimes committed by illegal immigrants?! https://t.co/KXZ8Xq6r4b— Bill Essayli (@billessayli) December 2, 2024 California already funds legal services for undocumented immigrants, including a separate fund solely for deportation defense, including $24 million in grants last year solely for deportation defense, and $37 million in grants this year for a wide range of other immigration-related legal services for legal and undocumented immigrants.  Under current guidelines, individuals who have been convicted of, or are currently appealing conviction of, a violent or serious felony are ineligible for state-funded deportation defense.  Last year, former Assemblyman Reginald Byron Jones-Sawyer Sr. proposed ending the ban on deportation defense for high-level felons. He also proposed allowing those funds to be used for providing “relief that vacates, eliminates, or reduces a criminal record, conviction, or sentence that may have adverse immigration consequences.”  The failed bill would have tied in with the 2022 Racial Justice Act, which allows undocumented immigrants to petition to overturn convictions if said convictions will result in “adverse immigration consequences,” as many higher-level felonies result in deportation orders. California Gov. Gavin Newsom‘s special legislative session to fund lawsuits challenging the coming Trump administration convened Monday. California’s state-funded legislative review agency found the state has no capacity for new spending commitments and faces annual deficits rising to $30 billion. It’s unclear whether the state plans on increasing deportation defense funding, and how it would fund a program expansion. The Pennsylvania Senate race was finally called when Democrat Bob Casey conceded that the Democrats were attempting to count ballots that had no date or the wrong date. Luckily, the Supreme Court sided with the RNC. But how do we prevent voting in a federal election from getting to this point in the future? “What we need is a voter’s election integrity bill of rights, because these crazy laws are really infringing on the voting rights of people who go to the polls, do it right,” Cleta Mitchell, senior legal fellow for the Conservative Partnership Institute, tells Jill Savage and Matthew Peterson of “Blaze News Tonight.” “There are a number of principles that we’re sort of coalescing around that need to be both in federal law and in state law,” she continues. “Only citizens vote, voter ID for every kind of voting, make sure that all ballots are received by the time the polls close on Election Day, make sure that there’s transparency and accountability.” “This situation needs to be corrected. It’s way past time to do that,” she adds. Illinois is one state that has pushed the boundaries regarding election integrity, allowing mail-in ballots to be counted up to fourteen days after the election. “Do you think that this is something where the Supreme Court, or the courts, might not ultimately decide in the right direction? It just seems so egregious, but people now, they’re kind of used to it, in our corrupt system, allowing these mail-ins to come in after the fact,” Peterson comments. “Judicial Watch has filed suit in both Illinois and also Mississippi, and the Fifth Circuit ruled that receiving ballots after the time the polls close on Election Day violates the federal statute,” Mitchell responds. “I think that one of the things that we need to do is say that there’s a beginning and an end when we as a country vote, pretty much at the same time,” she continues. “We might have to make some accommodations for people to vote in person early if they’re going to be out of state.” “I think we need to get rid of this universal vote by mail, this universal sending of ballots to people whether they requested them or not,” she adds.
