Billionaire Oprah Winfrey spoke at the Democratic National Convention on Wednesday evening and told the crowd that “there is no American Dream” without abortion. Senator Ted Cruz (R-TX) said on Thursday that the Federal Trade Commission may be violating Americans’ due process rights by using a “fringe, left-wing” legal theory to sue companies for alleged racial discrimination, according to a letter exclusively shared with The Daily Wire.  In the letter, Cruz asks FTC Chair Lina Khan to provide information on whether the commission was filing multimillion-dollar lawsuits against corporations based on the theory that disparities must equal discrimination. Cruz, the ranking member of the Senate Commerce Committee, said that the FTC’s reliance on “disparate impact theory” and a controversial statistical model that uses a person’s name to guess their race may be unconstitutional. “I am concerned that instead of relying on sound evidence and acting within the law, the FTC is suing — and threatening to sue — companies for racial discrimination under the fringe, left-wing disparate impact legal theory,” Cruz wrote. “Perhaps even more troublingly, the FTC is basing such discrimination claims on a discredited and congressionally rejected model that guesses a person’s race based on their name.” Cruz said that the FTC was “searching for statistical disparities to justify enforcement actions” and that Congress had never granted the commission the authority to bring lawsuits based on that data. He noted that in 2018 Congress blocked the Consumer Financial Protection Bureau from utilizing disparate impact theory.  The letter comes days after FTC Commissioner Melissa Holyoak released a statement saying that the commission should consider the “propriety” of bringing discrimination claims “based on a disparate impact theory, as well as use of such theory against an individual defendant.” Tickets for “Am I Racist?” are on sale NOW! In his letter, Cruz said that the FTC was using the Bayesian Improved Surname Geocoding (BISG) model to bring lawsuits, a technique the senator said was “flawed” and riddled with “known faults.”  “Stereotyping a person’s race by their name is not just unseemly, but prone to significant inaccuracy,” he wrote. “Moreover, the FTC’s use of race-guessing to bring lawsuits may be unconstitutional.” Cruz said that the FTC had not disclosed to companies it had sued that it had based some of its analysis on using the BISG model.  “It is understandable why the FTC has not disclosed this practice to companies subjected to enforcement actions: BISG has been rightly criticized for its high error rates for racial minorities,” Cruz wrote.  Cruz said Khan should provide details on each statistical proxy model the FTC has used to generate information to bring enforcement actions over the past five years. He also asked her to provide information on the commission’s use of disparate impact theory.

Brown-Forman Corp., the company that makes the iconic Jack Daniels whiskey, has reportedly decided to terminate Jack Daniels’ diversity, equity and inclusion program after a boycott was threatened. On Wednesday, the Jack Daniels company issued a letter from its Executive Leadership Team. They announced, “[W]e launched our diversity and inclusion strategy in 2019. Since then, the world has evolved, our business has changed, and the legal and external landscape has shifted dramatically, particularly within the United States. With these new dynamics at play, we must adjust our work to ensure it continues to drive business results while appropriately recognizing the current environment in which we find ourselves.” The letter added that the company would be “removing our quantitative workforce and supplier diversity ambitions; ending participation in the Human Rights Campaign’s Corporate Equality Index survey; and reviewing training programs for consistency with an evolved strategy,” as conservative activist Robby Starbuck, who had planned to launch a boycott, reported. Starbuck revealed that the letter came from a “screenshot of one of the multiple folders we have on them. In an open letter to the public, Harley-Davidson said it was no longer implementing DEI policies and would enact strict protocols for future corporate sponsorships and affiliations. The announcement comes as other companies like Tractor Supply have moved away from DEI after conservative customers spoke out. Rumor has it that fast food chicken purveyor Chick-fil-A will launch a streaming service of unscripted content. Deadline reported that the popular restaurant chain has been working with major players in the entertainment industry to create, license, and acquire family-friendly content. The outlet’s sources revealed that new projects include a game show from Glassman Media, creator of “The Wall,” and Sugar23, which is known for the Netflix hit series “13 Reasons Why.” Those sources noted that the projects could launch as early as this year and that there’s also been talk of animation and scripted content. The company created “Stories of Evergreen Hills,” a series of short animated films published on its website. The series “follows a young girl named Sam as she discovers how little acts of kindness can bring people together,” the description says. While fast food and entertainment may seem like an unlikely pairing, it’s not the first time two seemingly unrelated industries teamed up. The outlet noted that ride-share company Lyft produced an eight-episode game show series called “Lucky Lyft Trivia Show” hosted by Bob the Drag Queen. Also, Airbnb produced the documentary “Gay Chorus Deep South” for MTV in 2019, which was about the San Francisco Gay Men’s Chorus touring the South.
