Elon Musk Sues OpenAI

Elon Musk has sued Open AI. In a recent federal court filing, Musk asked the court to stop OpenAI from converting into a fully for-profit business. Attorneys representing Musk, xAI, and a former OpenAI board member filed a preliminary injunction on Friday afternoon. The injunction will also prevent OpenAI from requiring its investors not to invest in AI startup competitors such as xAI. Musk invested nearly $50 million in OpenAI in its early days. Attorneys representing Musk, his AI startup xAI, and former OpenAI board member Shivon Zilis filed for a preliminary injunction against OpenAI on Friday. The injunction would also stop OpenAI from allegedly requiring its investors to refrain from funding competitors, including xAI and others. The latest court filings represent an escalation in the legal feud between Musk, OpenAI and its CEO Sam Altman, as well as other long-involved parties and backers including tech investor Reid Hoffman and Microsoft. Musk had originally sued OpenAI in March 2024 in a San Francisco state court, before withdrawing that complaint and refiling several months later in federal court. Attorneys for Musk in the federal suit, led by Marc Toberoff in Los Angeles, argued in their complaint that OpenAI has violated federal racketeering, or RICO, laws. In mid-November, they expanded their complaint to include allegations that Microsoft and OpenAI had violated antitrust laws when the Chat GPT-maker allegedly asked investors to agree to not invest in rival companies, including Musk’s newest startup, xAI. Alongside this new filing, Musk’s team also named the likes of OpenAI’s CEO Sam Altman and President Greg Brockman, together with Dee Templeton, Microsoft’s Vice President of Technology & Research Partnerships and Operation; and LinkedIn’s Reid Hoffman as defendants. This latest motion from Musk is now looking to prevent OpenAI from adopting a for-profit business model which means that it can align itself to a single corporation for backing and funding their developments. Musk is known for arguing against this new governance structure that is set to be changed over at OpenAI, alleging that this is an anticompetitive practice from both OpenAI and Microsoft that could undermine its rivals, particularly xAI.

Could Miami-Dade County, the most populated county in the Sunshine State, soon remove fluoride from its drinking water? A Miami-Dade commissioner cheered recommendations by Florida Surgeon General Dr. Joseph Ladapo to remove fluoride. “You’re absolutely right @FLSurgeonGen. Gonzalez (@RobJGonzalezFL) November 23, 2024 Miami Herald reports: While new to Miami-Dade, the fluoride debate has been gaining steam in recent years. Two recent developments helped energize the push against fluoride in drinking water. One was a federal study released in August by the National Toxicology Program, part of the Department of Health and Human Services, that linked lower IQs in children with high levels of fluoride exposure — at rates about double the fluoride that’s found in Miami-Dade and other municipal water systems. The other development was a September ruling by federal Judge Edward Chen, appointed during Barack Obama’s presidency, ordering the Environmental Protection Agency to take action over what the judge concluded were reasonable concerns about harm caused by fluoride in drinking supplies. That conclusion was based in part on the National Toxicology Program’s study. “In all, there is substantial and scientifically credible evidence establishing that fluoride poses a risk to human health,” Chen wrote in a Sept. 24 ruling for an advocacy group demanding EPA action on fluoride. “It is associated with a reduction in the IQ of children and is hazardous at dosages that are far too close to fluoride levels in the drinking water of the United States.” Miami-Dade commissioner supports removing fluoride from water https://t.co/D9MatIPlaw — Daniel Horowitz (@RMConservative) December 2, 2024 Ladapo advised all cities and counties statewide to stop adding fluoride to drinking water. Dr. Ladapo spoke at a news conference in Winter Haven, which announced it would not add fluoride to its drinking water by the end of the year. WATCH: FOX 13 Tampa Bay reports: The debate over whether fluoride poses a health hazard when ingested goes beyond the brain, with critics arguing it could also cause dental and bone diseases. Supporters of fluoridation, though, consider it one of the greatest public health achievements of the last century. Dr. Ladapo’s stance on the issue is in line with that of Robert F. Kennedy, Jr., President-elect Donald Trump’s nominee for secretary of the Department of Health and Human Services. Kennedy has said he would recommend removing fluoride from drinking water nationwide. The U.S. Environmental Protection Agency (EPA) is now studying the issue more, as well, although it could take up to three years to find out the results.
