BREAKING: Jack Smith Moves To Dismiss All Charges In Federal Election Interference Case Against President Trump

Special counsel Jack Smith moved to dismiss all charges in the federal election interference case against President Trump. “As a result of the election held on November 5, 2024, the defendant, Donald J. Trump, will be inaugurated as President on January 20, 2025. It has long been the position of the Department of Justice that the United States Constitution forbids the federal indictment and subsequent criminal prosecution of a sitting President. But the Department and the country have never faced the circumstance here, where a federal indictment against a private citizen has been returned by a grand jury and a criminal prosecution is already underway when the defendant is elected President,” a court filing read. “Confronted with this unprecedented situation, the Special Counsel’s Office consulted with the Department’s Office of Legal Counsel (OLC), whose interpretation of constitutional questions such as those raised here is binding on Department prosecutors. After careful consideration, the Department has determined that OLC’s prior opinions concerning the Constitution’s prohibition on federal indictment and prosecution of a sitting President apply to this situation and that as a result this prosecution must be dismissed before the defendant is inaugurated. That prohibition is categorical and does not turn on the gravity of the crimes charged, the strength of the Government’s proof, or the merits of the prosecution, which the Government stands fully behind,” it continued. “Based on the Department’s interpretation of the Constitution, the Government moves for dismissal without prejudice of the superseding indictment under Federal Rule of Criminal Procedure 48(a). The Government has conferred with defense counsel, who does not object to this motion,” it added. In newly filed court documents, federal prosecutors working in Smith’s office told U.S. District Judge Tanya Chutkan that they are seeking to close Trump’s case because Justice Department policy forbids the prosecution of a sitting president. “Jack Smith has filed a motion to dismiss ALL charges against President Trump. America won. pic.twitter.com/UFVnZqQR83 — Charlie Kirk (@charliekirk11) November 25, 2024 MSNBC reports: Once Trump won the presidential election, that meant that his two federal criminal cases (this one and the classified documents case) would eventually go away, whether by lawyers in the current Justice Department or the next one moving to dismiss, or Trump potentially attempting to pardon himself. The DOJ also has a policy against charging and prosecuting sitting presidents. Smith already was reportedly planning on resigning before Trump, who vowed to fire Smith, took office. Both federal cases were paused while the courts awaited word from Smith about how he wanted to proceed in the cases due to Trump’s election. Before that, the federal election interference case was back in the trial court with Chutkan, who was tasked with figuring out how to proceed with the case after the Supreme Court’s immunity ruling curtailed Smith’s charges. In the classified documents case, Smith was appealing U.S. District Judge Aileen Cannon’s dismissal of the case on the grounds that Smith was unlawfully appointed. Unlike the election interference case, Trump has two co-defendants in the classified documents case, which raises additional issues to consider on top of the fact that it is in an appellate court as opposed to the trial court. Three Uzbeks Arrested in UAE Over Murder of Chabad Rabbi Zvi Kogan

Three men suspected of murdering Chabad-Lubavitch emissary Rabbi Zvi Kogan were arrested, the Emirati Ministry of Interior confirmed on Sunday. The suspects, Olimpi Toirovich, 28, Makhmudjon Abdurakhim, 28, and Azizbek Kamlovich, 33 are citizens of Uzbekistan.  In a statement, the ministry said investigations and legal proceedings were initiated against the men for murdering Kogan, who was a UAE resident. The statement also praised its security authorities for quickly detaining the suspects who attempted to “undermine the safety and stability of the UAE community.” Photos released by the ministry show the men handcuffed and blindfolded. Kogan, 28, a Moldovan and Israeli citizen, was last seen alive in Dubai on Thursday. Over the weekend, his body was discovered in Al Ain, a city near the Oman border and approximately 90 minutes from Dubai. Kogan worked as an emissary for the Jewish group Chabad, by helping to support religious life for Jewish visitors and residents. He worked with the Chabad in Abu Dhabi and ran a kosher grocery store in Dubai.  The UAE has had a spike in Jewish and Israeli visitors since the establishment of formal ties with Israel under the Abraham Accords in 2020. The act of suspected terrorism may have been targeted at threatening the stability of the Abraham Accords. The White House National Security Council said the murder was also a crime against supporters of peace. “Our prayers are with his family, the Chabad-Lubavitch community, the broader Jewish community and all who are mourning his loss,” said Sean Savett, a spokesman for the council. “This was a horrific crime against all those who stand for peace, tolerance and coexistence. It was an assault as well on UAE and its rejection of violent extremism across the board.” Israeli Prime Minister Benjamin Netanyahu on Sunday called the murder an anti-Semitic terrorist attack and said that the Jewish state will seek justice against those who dispatched the three men. “This murder of an Israeli citizen and a Chabad emissary, is an abhorrent antisemitic terrorist attack,” Netanyahu said. “The State of Israel will use all means, and will deal with these murderers, and those who dispatched them, to the fullest extent of the law. None of them will get away.” Israel has information that Kogan may have been under Iranian surveillance, according to The Jerusalem Post. The chairman of Chabad, Rabbi Yehuda Krinsky, called upon governments around the world to protect their local Chabads. “It is incumbent upon the authorities of every country where Chabad representatives serve in good faith, to ensure that terror finds no haven within its borders. The targeting of Rabbi Kogan was an attempt to destroy the sacred Jewish values that he represented: light, goodness and kindness,” he said. “No country, no community, no society can afford the loss of these sustaining values.” Krinsky added that Kogan was “kidnapped and murdered in cold blood while serving the Jewish community in the UAE.” As of Monday afternoon, more than $630,00 was raised to support Kogan’s widow, who he married in 2022. Kogan’s wife is the niece of Rabbi Gavriel Noach Holtzberg and his wife Rikvah who were murdered by Islamic terrorists in Mumbai, India in 2008. Kogan’s funeral took place Monday evening in Kfar Chabad, Israel.
