The Left Outraged Over Daniel Penny’s Acquittal
Daniel Penny, who was charged with criminally negligent homicide for using a chokehold on Jordan Neely, was found not guilty by a Manhattan jury on Monday. In response to the decision, Neely’s supporters are now calling for violence and action.
“Just like everyone else has vigilantes, we need some black vigilantes,” Black Lives Matter NYC leader Hawk Newsome told ABC News. “People want to jump up and choke us and kill us for being loud? How about we do the same when they attempt to oppress us,” Newsome said.

Following the decision, Neely’s father, Andre Zachary, expressed his sympathy for his son and told the press that the “system is rigged … let’s do something about this.”

The decision came after the jury had deliberated for five days following eight weeks of testimonies. Penny initially faced two charges of manslaughter and negligent homicide, and the manslaughter charge was dropped on Friday due to concerns over a hung jury.
Arizona House Rep. Eli Crane told FOX News that he would introduce a bill to award Penny with a Congressional Gold Medal for his actions that protected the lives of those on the train. “Our system of ‘justice’ is fiercely corrupt, allowing degenerates to steamroll our laws and our sense of security while punishing the righteous. Mr. Penny bravely stood in the gap to defy this corrupt system and protect his fellow Americans,” Crane told FOX.

Penny, who is a Marine Corps veteran, was filmed choking Neely on a subway train on May 1, 2023. Witnesses on the train described Neely as acting disruptively and “trying to attack everybody” on the train, which led Penny to put him in a chokehold for six minutes until he fell unconscious.
Penny’s defense team held that Penny’s actions were “justified defense,” but prosecutors claimed it was “unintentional but criminally reckless or negligent.”
Jordan Neely was homeless, suffered from addiction and mental health issues, and had a criminal history of over 40 arrests. At the time of the incident, there was an outstanding arrest warrant for Neely for assaulting a 67-year-old stranger in 2021.
