After a seven-week trial that involved over 40 witnesses, the jury found Penny, a former Marine sergeant, not guilty of criminally negligent homicide. The case earned national coverage in part because many saw the incident as indicative of general social dysfunction in cities around the country and of the woes of New York City’s subway system—by far the country’s biggest—which has been plagued by mentally ill homeless people. The highly-anticipated verdict came on the fifth day of deliberations. Last week, a judge dismissed the top count — manslaughter — against Penny after the jury twice said they could not reach a unanimous decision. They weren’t able to consider the lesser charge of criminally negligent homicide until the top count had been resolved. Both charges were felonies and carried the possibility of prison time. Penny, 26, gripped Jordan Neely around the neck for about six minutes in a chokehold that other subway passengers partially captured on video. Penny’s lawyers said he was protecting himself and other subway passengers from a volatile, mentally ill man who was making alarming remarks and gestures.
