BREAKING: Supreme Court Agrees to Weigh Trump’s Appeal of Decision Removing Him From Colorado Ballot

The Supreme Court agreed Friday to hear former President Donald Trump’s appeal of the Colorado Supreme Court’s decision to kick him off the state’s ballot. The Colorado Supreme Court ruled Dec. 19 that Trump is ineligible to be on the state’s primary ballot under Section 3 of the 14th Amendment of the U.S. Constitution. The U.S. Supreme Court set oral arguments to consider Trump’s appeal for Feb. 8. Trump appealed the ruling to the Supreme Court on Wednesday. The Colorado Republican Party previously filed a separate appeal Dec. 27. “The question of eligibility to serve as President of the United States is properly reserved for Congress‚ not the state courts‚ to consider and decide‚” Trump’s petition stated. “By considering the question of President Trump’s eligibility and barring him from the ballot‚ the Colorado Supreme Court arrogated Congress’ authority.” Section 3 of the 14th Amendment prevents individuals who took an oath to the Constitution and then engaged in insurrection from holding office. BREAKING: The Supreme Court agreed to take up Trump's appeal of the Colorado Supreme Court's decision finding him ineligible to appear on the state's ballot. Oral arguments are scheduled for Feb. 8. @DailyCaller pic.twitter.com/xPUvqLryNA— Katelynn Richardson (@katesrichardson) January 5‚ 2024 Trump’s brief‚ along with any other friend-of-the-court briefs‚ must be filed by Jan. 18. The respondent’s brief is due by Jan. 31‚ and Trump’s reply brief is due by Feb. 5‚ according to the court’s order. Twenty-seven states filed an amicus brief Friday urging the Supreme Court to reverse the Colorado ruling. The Colorado Supreme Court acknowledged that it had traveled in “uncharted territory” when it issued the decision in December. “The sum of these parts is this: President Trump is disqualified from holding the office of President under Section Three; because he is disqualified‚ it would be a wrongful act under the Election Code for the Secretary to list him as a candidate on the presidential primary ballot‚” the Colorado Supreme Court wrote in its opinion. Maine Secretary of State Shenna Bellows also issued a ruling Dec. 28 finding Trump was ineligible to appear on the state’s ballot‚ which he appealed Tuesday. Colorado and Maine are among 16 states holding presidential primaries on March 15. Trump did not immediately respond to a request for comment. This is a breaking news story and might be updated.  Originally published by the Daily Caller News Foundation Have an opinion about this article? Claudine Gay Is Gone‚ but Diversity Ideology Still Plagues Harvard

Numerous and compounding reasons led to Claudine Gay’s removal as president of Harvard University. Her departure‚ while a necessary first step‚ does not solve the problems that required her departure and that continue to plague Harvard and much of higher education. Gay was manifestly unqualified for the position‚ with only a fraction of the scholarly accomplishments of her predecessors at Harvard and peers at other universities. She was obviously selected as a symbol for the diversity‚ equity‚ and inclusion—or DEI—ideology that Harvard wishes to promote‚ not because of her merit as a scholar. Gay even used DEI as a cudgel to eliminate rivals—much more accomplished black professors‚ such as Roland Fryer and Ronald Sullivan—with manufactured charges that they had created hostile work environments. But the use of DEI as a departure from academic merit and as a weapon for organizational combat is not eliminated with Gay’s departure. The DEI bureaucracy that she helped build and use for her ascent remains intact at Harvard and throughout higher education. The growing number of plagiarism charges against Gay focused more attention on her lack of scholarly merit as Harvard’s president. Like the old Catskills joke about the food being horrible and with such small portions‚ academic fraud characterized the meager research output Gay had produced. These plagiarism charges were more than sufficient reason for her removal as president‚ but the fact that she remains as a Harvard professor does not resolve the lowering of research standards that her misconduct represents. In addition‚ Harvard’s willingness to keep Gay as president until the instances of plagiarism became too numerous raises concerns about the double standards with which Harvard and other universities enforce their rules. They would have sanctioned a student immediately—and for far less. Critical attention on Gay gained momentum after her disastrous testimony before a U.S. House committee investigating antisemitic protests on university campuses. Her unwillingness to say that chanting genocidal slogans would violate Harvard’s code of conduct while the university regularly punishes much more benign speech highlighted Gay’s own use of double standards. But Gay’s removal does not resolve this double standard nor does it mitigate the rampant Jew-hatred found at Harvard and other elite institutions. Lastly‚ it should be noted that there have been no sanctions for the members of the Harvard board who hired Gay despite her obvious lack of qualifications‚ defended her plagiarism‚ threatened those investigating the matter‚ and embraced the DEI ideology and double standards that foment Jew-hatred on campus. They should be held accountable‚ too. Progress toward resolving these issues at Harvard and elsewhere could not be done without the removal of bad actors like Gay and the board members who enabled her. But the public campaign to fire Gay has not really fixed any of Harvard’s serious problems. Bloated DEI bureaucracies continue to promote the discriminatory ideology that people deserve different treatment depending upon the racial‚ ethnic‚ or sexual identities that place them in “oppressor” or “oppressed” categories. Standards for research integrity continue to weaken and be upheld differently depending on the preferred status of researchers and their findings. And the selective enforcement of codes of conduct that make universities more hostile to anyone deemed to be an oppressor‚ including Jews‚ white men‚ and believing Christians. The same public campaign that ousted Claudine Gay now needs to turn its attention to the policies and practices that allowed her to become Harvard president and produce enough disastrous publicity to force her removal. We need to dismantle DEI bureaucracies and uproot the ideology they promote on campus. We need to reestablish high and consistent standards for academic research. This would almost certainly require the elimination of academic departments that are characterized more by political advocacy than rigorous inquiry‚ such as ethnic and gender studies departments. We also need to get universities to adopt and consistently enforce strong protections of free academic speech while also fully prosecuting violations of their codes of conduct‚ including physical harassment‚ trespassing‚ and the use of the heckler’s veto to drown out disfavored speakers. Gay’s removal as the president of Harvard‚ following Liz Magill’s departure at the University of Pennsylvania‚ suggests that the tide is turning in academia. But much still needs to be done to bring these institutions back to serving their original and laudable missions. This piece originally appeared on FOXNews.com. Fact-Checking 4 Biden Claims in Valley Forge Speech

Fact-Checking 4 Biden Claims in Valley Forge Speech

President Joe Biden on Friday accused Donald Trump‚ his predecessor and the leading contender for the Republican presidential nomination‚ of wanting to be a dictator.  Biden spoke at a community college about 15 miles east of Valley Forge‚ a historical site in the battleground state of Pennsylvania that Trump won in 2016 but lost in 2020 to Biden.  The president’s remarks targeting Trump came on the eve of the third anniversary of the Capitol riot on Jan. 6‚ 2021‚ in which Trump supporters stormed the Capitol. Some were attempting to stop a joint session of Congress from certifying Biden’s defeat of Trump in the 2020 presidential election. During the Revolutionary War‚ Valley Forge was an encampment for American soldiers during the cold‚ harsh winter of 1777-78. Gen. George Washington‚ commander of the Continental Army‚ recruited a former Prussian military officer‚ Friedrich Wilhelm von Steuben‚ to reinvigorate his despairing troops for battle with the British. Here is a look at the accuracy of some of Biden’s strongest assertions in his speech Friday‚ billed as the first event of his reelection campaign in the new year.  1. ‘Democracy Is on the Ballot’  Biden said Trump posted the words‚ “power‚ revenge‚ and dictatorship” on his social media.  What Biden apparently was referring to is a word cloud published in the Daily Mail‚ a U.K. newspaper‚ where readers offered words that most described the candidates. Biden’s word cloud focused on the word “nothing‚” the most popular‚ followed by “economy” and “peace.” Other words were “money” and “power.” Trump’s word cloud included “power‚” “revenge‚” “dictatorship‚” “America‚” and “border.”  Trump posted his word cloud on Truth Social‚ the social media company that he owns‚ implying that he was flattered by the characterizations.  “There is no confusion about who Trump is and what he intends to do‚” Biden said.  “Democracy is on the ballot. Your freedom is on the ballot‚ your freedom to vote and to have your vote counted‚” the president said. Although hyperbole is common in political campaigns—including Trump’s—Biden’s key argument appeared to be that if he isn’t elected to a second term‚ Trump would take over as a dictator.  Trump did say‚ apparently playfully‚ during a December town hall meeting on the Fox News Channel that he would be a dictator only on the first day if elected to another term. “Other than that‚ I am not a dictator‚” Trump quipped. The former president seemed to be joking‚ although more than a few Democrats warned that he was serious. It’s not possible to prove whether someone was joking or serious without reading his or her mind‚ of course. In the incident Biden cited‚ Trump didn’t specify that he would ignore the authority of Congress‚ the judicial branch‚ and state governments on his first day back in office. Rather‚ he seemed to be referring to issuing executive orders.  Typically‚ a dictator would not set a limit—such as only one day of dictatorial behavior—on his time in power.  During the Dec. 5 town hall‚ Fox host Sean Hannity asked Trump to respond to the rhetoric of Democrat critics‚ saying: “To be clear‚ do you in any way have any plans whatsoever if reelected president to abuse power‚ to break the law‚ to use the government to go after people?”  Trump initially responded by saying that’s what the Biden administration is doing to him.  “Like they’re doing right now?” he asked Hannity. The former president then referred to the federal prosecutions targeting him‚ which he says are purely political.  “In the history of our country what’s happened to us‚ again‚ has never happened before over nonsense‚ over nothing‚ made-up charges‚” Trump told Hannity. “We are going to do things. We will close the border‚ Day One. The border gets closed‚” Trump said. “Day One and a half‚ we drill. Drill‚ baby‚ drill. Drill‚ drill‚ drill. And probably on Day Two we will get rid of this ridiculous electric car mandate.”  Hannity asked again: “You are not going to be a dictator‚ are you?” Trump‚ referring to Hannity‚ appeared to josh the audience at Fox’s town hall: “I love this guy. He says‚ ‘You’re not going to be a dictator‚ are you?’ I say‚ “No‚ no‚ no‚ other than Day One. We are closing the border and drilling‚ drilling‚ drilling. Other than that‚ I am not a dictator.” 2. ‘Nearly Lost America’ Biden also talked Friday about the threat posed to America by the Capitol riot on Jan. 6‚ 2021. “It was on that day that we nearly lost America‚ lost it all‚” Biden said. “Today‚ we’re here to answer the most important of questions: Is democracy still America’s sacred cause? This is not rhetorical‚ academic‚ or hypothetical.” A total of 1‚240 pro-Trump protesters were charged with committing crimes Jan. 6‚ according to the FBI as of Thursday. Most were accused of felonies in connection with storming the Capitol to stop certification of Biden’s win. The riot began before Trump finished speaking at a rally on the Ellipse near the White House‚ in which he again claimed the election was stolen.  However‚ it’s highly debatable that the American government was close to being overthrown—or‚ as Biden said in his speech Friday‚ “nearly lost.”  With a few exceptions for convictions for seditious conspiracy‚ most of the criminal charges brought by Biden’s Justice Department don’t reflect that seriousness‚ and the riot was over within about five hours.   According to the FBI‚ a total of 452 were charged with assaulting law enforcement officers. Prosecutors charged at least 50 with conspiracy.  Seditious conspiracy‚ the most serious of the charges‚ refers to a plot against the country.  Two members of the controversial group Proud Boys were convicted of seditious conspiracy. At least four members of another group‚ Oath Keepers‚ also were convicted of seditious conspiracy.  Federal law (U.S.C. 2384) defines seditious conspiracy this way:  If two or more persons in any State or Territory‚ or in any place subject to the jurisdiction of the United States‚ conspire to overthrow‚ put down‚ or to destroy by force the Government of the United States‚ or to levy war against them‚ or to oppose by force the authority thereof‚ or by force to prevent‚ hinder‚ or delay the execution of any law of the United States‚ or by force to seize‚ take‚ or possess any property of the United States contrary to the authority thereof‚ they shall each be fined under this title or imprisoned not more than twenty years‚ or both. 3. ‘One Desperate Act’ Biden asserted Friday that Trump wanted the Jan. 6 riot to embroil the Capitol.  “The legal path just took Trump back to the truth. That I was the winner and he was the loser‚” Biden said‚ referring to the former president’s multiple losses in court in challenging the election results.  “Knowing how his mind works‚ he had one act left‚” Biden said. “One desperate act available to him. The violence of Jan. 6.” Again here‚ Biden suggested an intention on Trump’s part‚ which isn’t possible to prove or disprove. However‚ special counsel Jack Smith didn’t charge Trump with insurrection in a court case set to begin in March.  In that case‚ a federal trial will decide whether Trump tried to alter the outcome of the 2020 election. Smith secured an indictment against Trump that charges him with conspiracy to defraud the United States; conspiracy to obstruct an official proceeding; obstruction of and attempt to obstruct an official proceeding; and conspiracy against rights.  Again‚ Smith didn’t charge Trump with insurrection. Also‚ none of these charges is related to the Capitol riot.  At one point in his speech Friday‚ Biden said: “What has Trump done? Instead of calling them criminals‚ he’s called these insurrectionists patriots.” This assertion is accurate at least in part. Although Trump condemned the rioters in a speech on Jan. 7‚ 2021‚ he said as early as the following summer that some protesters were “patriots.” Separately‚ Trump referred to the crowd at his Jan. 6 rally as “loving.” Biden also faulted Trump for pledging to pardon Jan. 6 rioters.  Trump has said he would pardon a “large portion” of those who were charged.  Biden went through the rhetoric of Trump’s remarks on the Ellipse just before the riot began.  “He told the crowd to ‘fight like hell‚’ and all hell was unleashed‚” Biden said. “He promised he would right them‚ right them [sic]‚ everything they did‚ everything they did‚ he would be side by side with them.” For the most part‚ this is an accurate characterization by Biden. But the president left out an important detail—Trump called for the crowd to stay “peaceful.” He also mentioned‚ “I’ll be there with you‚” suggesting he would be marching with them near the Capitol. “Now‚ it is up to Congress to confront this egregious assault on our democracy. And after this [rally]‚ we’re going to walk down—and I’ll be there with you—we’re going to walk down‚ we’re going to walk down [to the Capitol]‚” Trump said on Jan. 6‚ 2021.  He also told the crowd: “I know that everyone here will soon be marching over to the Capitol building to peacefully and patriotically make your voices heard.” 4. ‘Book Banning’ In his speech Friday‚ Biden brought up a talking point among Democrats who advocate that sexually explicit books be available in school libraries.  Biden talked about “those who seek to bury history and ban books.” He asked the crowd: “Did you ever think you could be in a political event talking about book banning in a presidential election?” Biden didn’t offer examples of anyone seeking to ban books. Democrat politicians and some interest groups‚ however‚ have used the term “book banning” regarding parents’ concern about age-appropriate books for elementary school libraries.  The books in question include the titles “Gender Queer‚” “Flamer‚” “Lawn Boy‚” “Fun Home‚” and “It’s Perfectly Normal: Changing Bodies‚ Growing Up‚ Sex‚ and Sexual Health.” Critics say the books contain images of people engaged in sex acts or graphic descriptions of those acts.  Parents recently have opposed certain books in school libraries. And although some books were removed from elementary school libraries‚ or from easy access there‚ no political leader has advocated banning or restricting the existence‚ sale‚ or publication of such books.  As The Daily Signal reported in May‚ books that the organization PEN America claimed were banned actually were still stocked by public and school libraries. Does Katt Williams’ interview expose Stephen A. Smith as a fraud?

It’s difficult to adequately summarize the three-hour attack comedian Katt Williams unleashed on the entertainment industry earlier this week.Williams carpet-bombed so many big names and spent so much time riding third rails that interviewer Shannon Sharpe authentically wondered whether any high-profile Hollywood guests would return to his popular podcast “Club Shay Shay.”The elimination of merit directly connects to the pandemic of lies plaguing our country.Williams proclaimed the year 2024 as the year of truth.“All people that love the truth got to be happy if the truth is coming out and lies are getting exposed. That's just what time it is 2024‚” he declared after taking major swipes at Diddy‚ T.D. Jakes‚ Harvey Weinstein‚ Kevin Hart‚ Steve Harvey‚ Chris Tucker‚ Cedric the Entertainer‚ Ludacris‚ and the “Illuminati” and insinuating major stars are controlled through sexual malfeasance.Williams argued that the entertainers at the top of the comedic industry don’t advance through hard work and talent. Rather‚ they rise and fall based on their entrance into secret alliances and willingness to promote the messages Hollywood elites dictate. He leveled his most direct criticism at comedian Kevin Hart.“Have we heard of a comedian that came to L.A.‚ and in the first year in L.A.‚ he had his own sitcom on network television and had his own film called ‘Soul Plane’ that he was leading? No. We’ve never heard of that before that person or since that person. What do you think a plant is?”Williams ripped Steve Harvey for promoting a false personal narrative about being homeless. Williams claimed Cedric the Entertainer stole a joke from him. Williams referenced Chris Tucker’s association with sex trafficker Jeffrey Epstein. Williams said the Illuminati promised Ludacris $200 million and a light-skinned wife. By the time the tiny comedian mentioned reading 3‚000 books a year as a child‚ being qualified for college at age 7‚ and running a 4.3 40-yard dash as a junior-high football player‚ the average listener was likely overwhelmed and a bit unsure what to believe. Here’s what you should believe: the people at the top of the influence industries — arts‚ entertainment‚ media‚ academia‚ and politics — have been installed by a small handful of elite powerbrokers. Merit has been eliminated from American culture. That’s what Katt Williams was really complaining about. The tiny comedian believes he has superior talent‚ work ethic‚ insight‚ and integrity to many of his more-celebrated peers. He’s frustrated that American culture has become so corrupt and controlled that obvious‚ blatant lies pass for infallible truths.Journalists are supposed to be truth-tellers. Now‚ we’re nothing more than entertainers and co-conspirators in the lies being foisted on the public. Many of us can relate to his frustration. The elimination of merit directly connects to the pandemic of lies plaguing our country. The people at the top of the influence industries must support the following lies or face ridicule as bigots‚ homophobes‚ anti-Semites‚ transphobes‚ sellouts‚ coons‚ and misogynists: Diversity is America’s strength. We must implement racism to fix racism.Biological men should compete against women in sports. The vaccine prevents COVID.“All lives matter” is racist. Child mutilation is “gender-affirming care.”Gender dysphoria is not a mental illness. Abortion is health care. Traditional Christianity is racist.America is systemically racist. The patriarchy is evil. American secular Jews do not have enormous power in Hollywood or in the media. January 6 was “an insurrection.” Trump supporters are racists.Racism caused George Floyd’s death‚ not years of drug abuse and resisting arrest. That’s at least 15 lies you must support or ignore in order to avoid character assassination in modern American culture. No wonder Katt Williams is angry. No wonder he spent three hours calling out his peers. Comedians are supposed to be truth-tellers. They’re supposed to point out the lies prevalent in society‚ not provide cover for them.I can relate to every bit of Katt Williams’ angst. He realizes George Carlin will likely be jailed in 2024. I feel the exact same way about Mike Royko‚ my journalism hero. Journalists are supposed to be truth-tellers. Now‚ we’re nothing more than entertainers and co-conspirators in the lies being foisted on the public. Stephen A. Smith is the Kevin Hart of the sports media. Smith is a plant. Disney and ESPN installed Smith at the top of sports media because his inadequacies as a journalist make him easy to control. When I listened to Katt Williams talk about Kevin Hart and Steve Harvey‚ my mind immediately drifted to Smith’s memoir. Smith’s story doesn’t add up. When you don’t earn a position‚ your loyalties go to the handlers who installed you. It’s why Harvard chose Claudine Gay‚ why Joe Biden chose Ketanji Brown-Jackson and Kamala Harris‚ and why the music industry celebrates rap and the talentless hacks willing to rhyme the N-word every 10 seconds and brag about the color and flexibility of their booty and other privates. Let me return to Smith. Last year‚ I publicly feuded with Smith‚ the host of ESPN’s “First Take” program. He repeatedly referred to me as “fat bastard.” The barbs tickled me. They also made me take an even deeper interest in how someone with such limited journalistic skills became the face of the worldwide leader in sports. Smith released a memoir in 2023 called “Straight Shooter.” I read it. It’s farcical. When I listened to Katt Williams talk about Kevin Hart and Steve Harvey‚ my mind immediately drifted to Smith’s memoir. Smith’s story doesn’t add up. He (or his ghostwriter) claims he received a full basketball scholarship from Winston-Salem State after a one-day tryout in February 1988. A former Winston-Salem State basketball player allegedly drove Smith from New York to North Carolina for the tryout after Smith impressed the former player during a one-on-one matchup on a playground court. According to his book‚ Smith arrived on campus on a Saturday‚ checked into a hotel‚ and woke up Sunday morning to participate in a scrimmage. Before I go farther‚ let me add that Smith played one year of high school basketball. He rode the bench for the 1985-86 Thomas Edison High team as a senior. In the book‚ he says his one season of prep basketball ended abruptly when he failed a single assignment in a single class. He didn’t fail the class. He failed an assignment and was removed from the team. After his abbreviated high school career‚ Smith matriculated to Fashion Institute of Technology College of New York. It’s a school for women and men interested in joining the fashion industry. Smith enrolled so he could play on FIT’s junior college basketball team. He rode the bench at FIT‚ too. In his book‚ Smith described a work‚ school‚ basketball‚ and commute schedule that sounded humanly impossible. So‚ after riding the bench in high school for a year‚ riding the bench at a junior college for a year‚ and impressing an old player on a New York playground‚ Smith earned a tryout in front of Winston-Salem State’s legendary coach Clarence “Big House” Gaines. And this tryout happened on a Sunday‚ at the end of the regular season. Not many college teams hold scrimmages on a Sunday‚ one day after playing an important regular season game on a Saturday. But that’s how important it was for Big House to get a glimpse of a 6-foot-1‚ 150-pound guard with no high school or junior college accomplishments. According to Smith’s account‚ he knocked down 17 straight shots in the scrimmage‚ and Big House offered him a full scholarship immediately after the practice. This is laughable. In Big House’s own memoir‚ he frequently complained about his limited budget at WSSU. The historically black Division II program was not flush with cash and a dozen scholarships to toss around. We’re supposed to believe that Gaines gave one to a frail kid he saw play for an hour?I cannot appropriately do justice to the far-fetched story Smith painted in “Straight Shooter.” Smith has struggled to explain it on national TV. In November 2022‚ on the set of “NBA Countdown” with Malia Andrews‚ Jalen Rose‚ and J.J. Redick‚ ESPN ran a graphic of Smith‚ Rose‚ and Redick’s senior year stats. Smith allegedly averaged 1.5 points per game. He said he scored so few points because he played in just one game after a knee injury. You can’t average 1.5 points in one game. It’s impossible. In August 2023‚ on his podcast show‚ Smith backtracked and said he never played a single game at WSSU. It’s a bizarre contention‚ especially considering Smith is listed on a 1991 WSSU stat sheet as having played nine games. Is that a different Stephen Smith?Smith’s entire existence at WSSU is weird. His “First Take” show has traveled back to the campus at least twice. But we’ve never been shown more than one picture of Smith at the school. It’s a standard headshot for a game-day program. There are no action shots of Smith as a player. Nothing from him socializing with his friends on campus. Smith’s memoir doesn’t feature a single picture. The face of ESPN wrote a memoir‚ and I can’t find a legitimate review of it from any major or small publication. Smith pals around with a handful of former WSSU teammates — Gary Stephens‚ Phil Hayes‚ and Marc Turner — who appear to comprise the shortest college basketball team in history. It’s weird. So is the woman who has appeared on “First Take” as Smith’s former college professor‚ Marilyn “Mama” Roseboro. She’s listed in old yearbooks and newspaper accounts as a special assistant to the chancellor. Her public interviews with Smith paint the picture she taught him. Maybe she doubled as a professor.Smith’s memoir raises far more questions than answers about how he became the top personality in sports media. You read it‚ and Smith feels like a gimmick‚ a plant. You read it‚ and you realize Claudine Gay makes perfect sense. You read it‚ and you think Katt Williams is telling the truth about the entertainment industry. Smith either supports or remains silent on all 15 of the lies.

US Supreme Court to take up case on whether Trump can be barred from Colorado primary ballot

The U.S. Supreme Court will take up the matter of whether former President Donald Trump can be blocked from appearing on the 2024 primary ballot in Colorado.Oral arguments are scheduled for February 8. — (@) Trump has been trouncing the rest of the GOP presidential primary field in polls‚ but last month‚ the Colorado Supreme Court issued a ruling declaring that the secretary of state should not include the former president on the primary ballot. Three justices dissented. The move to bar Trump from the ballot is based on the notion that he supposedly engaged in insurrection on January 6‚ 2021‚ and because of that‚ is supposedly disqualified from seeking the presidency under Section Three of the 14th Amendment. GOP Sen. Mike Lee of Utah has asserted that Section Three of the 14th Amendment does not apply to the president. The Colorado Supreme Court's decision stated‚ "[W]e conclude that because President Trump is disqualified from holding the office of President under Section Three‚ it would be a wrongful act under the Election Code for the Secretary to list President Trump as a candidate on the presidential primary ballot. Therefore‚ the Secretary may not list President Trump’s name on the 2024 presidential primary ballot‚ nor may she count any write-in votes cast for him." "But we stay our ruling until January 4‚ 2024 (the day before the Secretary's deadline to certify the content of the presidential primary ballot). If review is sought in the Supreme Court before the stay expires‚ it shall remain in place‚ and the Secretary will continue to be required to include President Trump's name on the 2024 presidential primary ballot until the receipt of any order or mandate from the Supreme Court‚" the ruling read.Three of the justices currently sitting on the U.S. Supreme Court — Neil Gorsuch‚ Brett Kavanaugh‚ and Amy Coney Barrett — were nominated by Trump during his White House tenure.Maine Secretary of State Shenna Bellows has moved to block Trump from the primary ballot in that state. In her ruling‚ she said that there was "sufficient evidence to demonstrate the falsity of Mr. Trump's declaration that he meets the qualifications of the office of the presidency. Therefore‚ as required by 21-A M.R.S. § 336(3)‚ I find that the primary petition of Mr. Trump is invalid." She also noted‚ "I will suspend the effect of my decision until the Superior Court rules on any appeal‚ or the time to appeal under 21-A‚ Section 337 has expired."Like Blaze News?
