Donald Trump spoke out on Wednesday after a federal judge in Washington, D.C., publicly released a brief on presidential immunity from special counsel Jack Smith in the 2020 election subversion case against the former president. In a flurry of posts to Truth Social, Trump warned of election interference, arguing that the filing’s appearance on the public docket so close to the 2024 contest boosts a political scheme to undermine his current campaign. “Democrats are Weaponizing the Justice Department against me because they know I am WINNING, and they are desperate to prop up their failing Candidate, Kamala Harris,” Trump said in a post to his social media platform. He also questioned the timing, contending that it came “immediately” after Minnesota Democratic Gov. Tim Walz’s “disastrous” performance in the vice presidential debate and a little more than a month before the election. The filing was submitted under seal last week. Federal judge Tanya Chutkan was the one who ordered its release. Chutkan wrote Trump’s team provided “no support” to claims of “bad-faith partisan bias” and rejected the defense’s push for redactions beyond names to protect witnesses, citing the public’s “need to understand” the document. Smith’s brief discusses how his team’s superseding indictment should be able to abide by the Supreme Court’s ruling in July that presidents have immunity for official acts. Defense lawyers had previously argued that the debate over grappling with the presidential immunity issue should wait until at least December, but Chutkan said the court was “not concerned” with the schedule of the 2024 election. Trump has pleaded not guilty in the D.C. case, which got delayed as the courts weighed his presidential immunity claims. Smith’s second case against him — one related to classified documents — has been tossed by a judge in Florida. Alluding to the dismissal, Trump said in one of his posts to Truth Social that the 2020 election case “is a Partisan, Unconstitutional, Witch Hunt, that should be dismissed, entirely, just like the Florida case was dismissed!”

Candace Cameron Bure definitely got everyone’s attention when she announced there’s going to be a huge Christmas Festival with herself and the stars from the Great American Family. In a post on Wednesday on Instagram, the 48-year-old actress wrote, “THE WORD IS OUT! The Great American Christmas Festival is coming this holiday season in New York City! Dealing a significant blow to California’s attack on free speech through its legislative efforts to regulate AI-generated content, the Eastern District of California has issued a preliminary injunction against Assembly Bill 2839, which aimed to curb the spread of “deepfakes” and other digitally manipulated media during election periods. The ruling, delivered on October 2, 2024, sides with digital content creator Christopher Kohls, who argued that the law infringes on free speech rights and parody. Christopher Kohls, known online as “Mr. Reagan,” produces videos that use artificial intelligence to create parodies of political figures, including a controversial piece featuring an altered voice of Vice President Kamala Harris. Kohls filed the lawsuit shortly after AB 2839 was signed into law by Governor Gavin Newsom, claiming the legislation unfairly targeted his work as parody and satire. In the court’s decision, Judge John Mendez emphasized that the law did not pass constitutional muster, stating, “AB 2839 does not pass constitutional scrutiny because the law does not use the least restrictive means available for advancing the State’s interest here.” The judge highlighted alternative approaches like counter-speech that could address concerns about misinformation without restricting free speech. The ruling criticized AB 2839 for its broad application, which could potentially chill free speech. “While California has a valid interest in protecting the integrity and reliability of the electoral process, AB 2839 is unconstitutional because it lacks the narrow tailoring and least restrictive alternative that a content based law requires under strict scrutiny,” the order stated. The ruling criticized AB 2839 for its broad application, which could potentially chill free speech. “‘Especially as to political speech, counter speech is the tried and true buffer and elixir,’ not speech restriction.” Defendants in the case, including California Attorney General Rob Bonta and Secretary of State Shirley Weber, argued that the law was a necessary tool to protect the integrity of elections from the harms caused by AI-generated false content. However, the court disagreed. One of the more contentious aspects of AB 2839 was its requirement for disclaimers on satirical or parody content, something that satire site The Babylon Bee highlighted in its lawsuit, which Kohls and other critics argued would undermine the effectiveness and inherent value of such works. The injunction will hold until a further court decision is made, leaving the future of AB 2839 and similar laws (hopefully) in limbo. Man beats 6-year-old stepson to death with a metal bat in front of his family, police say

Connecticut police say a man beat his 6-year-old stepson to death with a metal bat in an attack on his family in Bridgeport. The family of 6-year-old Jathan Escobar told WFSB-TV that he was hospitalized with brain damage and on life support before he was pronounced dead on Wednesday. 'No matter what was going on, he was always so happy with everybody.' Police said that the boy's 38-year-old stepfather, Abdulrahim Sulaiman, was arrested and charged with murder with special circumstances. Sulaiman's 33-year-old wife told police she only knew him for about a year and they had been married for months. She claimed that the man had been smoking PCP recently and was violent. The man allegedly attacked his wife and her children on Sept. 25 with the metal bat while the mother screamed for help from their apartment on Main Street. When police arrived and gave the child CPR, they said they could see brain matter through the injury in his head. Police said Sulaiman had been on probation and had a violent criminal record. Prior to the death of the child and the elevation of the charges to murder, his bond had been increased from $1 million to $10 million. “He was always so happy and he just enjoyed life altogether.
