Cook Political Report delivers more bad news for Democrats

Cook Political Report shifted New York Republican Rep. Mike Lawler's race from "toss up" to "lean Republican" on Friday, despite Democrats' efforts to recoup their losses from the 2022 midterm cycle. Lawler won his seat in New York's 17th Congressional District, a +3 Democrat district, by fewer than 2,000 votes, unseating Democratic incumbent Rep. Sean Patrick Maloney. Lawler and Republican Reps. Brandon Williams, Anthony D'Esposito, and Marc Molinaro all flipped their seats in the 2022 midterms.The New York races may be particularly consequential given the Republicans' narrowing majority in the House.Of the four New York Republican incumbents, Lawler's odds of re-election are the strongest. Molinaro's and D'Esposito's seats are both ranked "toss up," while Williams' seat is rated "lean Democrat." The latest polls show the freshman congressman with a slim advantage over Democratic challenger Mondaire Jones. Jones formerly served New York's 17th Congressional District from 2021 to 2023 before running for New York's 10th Congressional District after a new congressional map was drawn in 2022. "Mondaire Jones has spent the better part of the past two years trying to rewrite history, and no one is buying it," Savannah Viar, a spokeswoman for the National Republican Congressional Committee, said in a statement. "The momentum is on the side of common-sense leader Mike Lawler, who will be re-elected in November." The New York races may be particularly consequential given the Republicans' narrowing majority in the House. Of the 435 seats, three are vacant, while Republicans currently hold 220 seats and Democrats hold 212.Like Blaze News? 'Craziness': IOC spokesperson claims no 'reliable' test to determine a male from a female

Jennifer Sey is a former pro athlete and brand president of Levi’s — who is now a fierce advocate for saving women’s sports from being infiltrated by men. “I swear I’m going to lose my mind,” Sey tells James Poulos of “Zero Hour.” “The spokesperson for the IOC just said this morning there’s no reliable test to tell the difference between males and females.” While Poulos and Sey agree that what’s been happening is absolute insanity, Sey believes it’s “deliberately obtuse and politically motivated.” “The other argument they use is, ‘Any test we might do is just too intrusive,’” Sey continues. “Well, I will tell you, as an internationally competitive athlete that competed before this, before we didn’t think the tests were accurate, we were tested regularly for drug use.” “We had to pee in a cup in front of a person at every national and international competition,” she says. “I didn’t even think it was intrusive. I wanted it to be fair, I wanted a fair fight in the competition.” “I can always accept losing if it’s a fair fight,” she adds, explaining that something like 85% of female athletes are in favor of testing for sex eligibility simply because “they too want a fair fight.” Two major stories from earlier this year surrounded the boxers who failed the sex eligibility tests but were allowed to compete against women in the 2024 Olympics regardless of the results. “They did not challenge the testing results in the court of arbitration, which might suggest they knew that the testing results were accurate, and since then, the IOC has snatched regulation and oversight of boxing away from that individual sports governing body,” Sey says. Boxing is now the only sport in the Olympics being governed directly by the International Olympic Committee. “This male boxer punches a woman repeatedly while she’s up against the ropes, with her throat against the rope, in the back of the head. Not disqualified,” She says, adding, “these female boxers are being told to sit down, shut up, take it. This is what you have to do to be inclusive.” “Craziness,” Poulos comments in disbelief. Biden's 'lock him up' remark sparks Trump's latest legal counterattack in federal election case

President Joe Biden's "lock him up" remark against Donald Trump this week has prompted the former president's legal team to file a motion to dismiss the ongoing federal case against him.On Tuesday, while campaigning in New Hampshire for Vice President Kamala Harris, Biden told a group of supporters that Trump believes the Supreme Court's presidential immunity ruling gives him the authority to "actually eliminate, physically eliminate, shoot, kill someone who he believes to be a threat to him."'This unjust case was dead on arrival.'"I mean, so I know this sounds bizarre, it sounds like I said this five years ago, he'd lock me up," Biden stated."We gotta lock him up," the president declared.Moments later, Biden attempted to backpedal, adding, "Politically, lock him up — lock him out, that's what we've got to do."On Thursday, Trump's legal team filed a motion to dismiss the federal case that claims he attempted to overturn the 2020 presidential election.In the motion, his lawyers pointed to Biden's Tuesday comments as evidence that the case is nothing more than a political vendetta. Trump's legal team wrote, "The proposed motion establishes that this unjust case was dead on arrival — unconstitutional even before its inception."His attorneys further alleged that the appointment of special counsel Jack Smith was unlawful because it circumvented Congress."In November 2022, the Attorney General [Merrick Garland] violated the Appointments Clause by naming private-citizen Smith to target President Trump, while President Trump was campaigning to take back the Oval Office from the Attorney General's boss, without a statutory basis for doing so," the motion continued.Trump's attorneys argued, "Garland did so following improper public urging from President Biden to target President Trump, as reported at the time in 2022, and repeated recently by President Biden through his inappropriate instruction to 'lock him up' while Smith presses forward with the case unlawfully as the Presidential election rapidly approaches."Last week, U.S. District Judge Tanya Chutkan rejected Trump's request to delay Smith's public release of additional documents pertaining to the case.Trump's lawyers contended that the documents' release could amount to election interference with the upcoming presidential election just weeks away. However, Chutkan ruled that not releasing the records could "constitute — or appear to be — election interference."Smith's other federal case against Trump was dismissed in July after U.S. District Judge Aileen Cannon ruled that his appointment was unlawful.Like Blaze News? Man allegedly lights mailbox on fire, damaging Arizona voter ballots, but denies political motivation: Police

Arizona police said they were quickly able to identify and arrest a man who allegedly damaged voter ballots by lighting a mailbox on fire, but he has denied being motivated by politics. 'Ballot abuse is a felony in Arizona, and mailbox vandalism is a federal crime.' The Phoenix Fire Department responded to a fire reported in the early morning on Thursday at a drive-up mail collection box. They said an unknown man lit a fire inside the box at about 1:30 a.m. and then fled the area. "Approximately 20 electoral ballots were damaged, along with additional miscellaneous mail," said officials of the Phoenix Fire Department. A postal inspector took possession of the damaged mail, including the ballots. Police said that surveillance video led to the arrest of a 35-year-old man who allegedly told them he "wanted to be arrested" and denied having any political motivation for damaging ballots among the mail. A USPS spokesperson and postal inspector said that such instances are rare. "Postal Inspectors are working with the local election commission to ensure any affected election mail is remedied and that other mail is routed to the appropriate parties," read a statement from the USPS. Arizona Secretary of State Adrian Fontes (D) said that officials were working to make sure voters whose ballots were damaged could recast their votes. "Thanks to the swift response coordinated between election officials, law enforcement, and the postal service, we were able to recover many undamaged ballots and affected voters will be contacted to make sure they’re able to cast a vote. Any attack that strikes at our democratic process carries criminal consequences," said Fontes. "Ballot abuse is a felony in Arizona, and mailbox vandalism is a federal crime," he added. "Counties across Arizona have already equipped ballot drop boxes with security controls to prevent and detect physical attacks.
